Not having sold this bag of seed to you, I don't know all of the details. If I had a customer come to my store who purchased seed elsewhere & experienced problems, these are the kind of questions I would ask:
What expiration date was on the bag?
Was there good soil to seed contact; i.e., not a lot of old grass, weeds, etc. already there?
Seed should have been planted at 1/4" deep which is still very shallow.
At the least, if I were you, I would contact Pennington with the Lot Number off the bag to determine germ percentage.
On my bags of Smart Seed it states:
The Smart Seed Guarantee: If you, the consumer, are not satisfied with this product after use in accordance with packaging instructions, you may be eligible for a refund. Send original receipt, empty packaging and a brief explanation within 60 days of purchase. Upon verification, we will send you a refund check for the purchase price.

I used an entire bag of Tall Fescue about a month ago to re-seed a large area. New top soil was placed, starter fertilizer and water every day. Not one, NOT ONE, of the seeds ever sprouted. I particularly planned for late March so I could have new growth by now. Nothing, absolutely no seed took.

In the past I've always gone with Agway products but want to give Pennington a try, so this was my first experience, and most likely my last.

I've never seen an entire 40lb bag not sprout. I mean at least 1/2 of the seed or spots should have taken; nothing!!!!!

Hello, Glenn.
The Tall Fescue grass seed (which means it stands up straight and not tall) is zoned for your area to be planted in early fall. Germination is anywhere from 7-21 days. I believe the timing was just right and this will grow all winter for you. I don't know the brand of seed they used, but this should work out all right.

I live on Long Island, NY. Recently (about 10 days ago), my landscaper completely renovated my backyard. It was a mess of weeds and crabgrass with a rusted above ground pool (plain ugly!!). We took down the pool (Thank god as it was more work than its use warranted!!) and he tilled and regraded the entire back yard applying about 2 inches of top soil and seeded it with Tall Fescue (based on his advice) using a some kind of machine that both aerated and seeded simultaneously. They also rolled over the seed with what looked like a hand held steam roller. Now my yard in as flat as Yankee Stadium !!. As of today 10/19/10, we are just starting to see seedlings emerging from the ground in sporadic areas. I've been doing my best to properly irrigate the area.
based my location and the obvious change in the weather will the seed have time to grow ?? or, was the application done too late??
